This program is available for parents if their income earnings are within 133% of the federal poverty level. For a family of 4, this income ceiling is $33,383 per year. However, the family income requirements for children under 19 are much more lax, as they require an income limit of no more than 350% FPL. For a family of 4, that limit is $87,850.
For the most part, the applicants must be uninsured. The parents and guardians must be legal permanent residents for five years in the US if they’re not yet already citizens. The exceptions to this rule include children and pregnant women, as well as for qualified aliens like refugees.
Some children may grow older and become ineligible for the main Families and Children program, but they still have other options. One of these programs is the Medicaid Special, which is for children under 21 who do not qualify for other Medicaid programs. These children can still receive Families and Children benefits if their family income does not exceed 133% of the federal poverty level.
The other program is the special program for the Medically Needy. This provides qualified children with various Medicaid benefits, with the main exception of inpatient hospital services. To qualify for this, the child has to be less than 21 years of age, and their family income and resources are simply beyond the NJ Medicaid income limits. The “spend down” provision allows the subtraction of documented medical expenses from the net family income so the income can meet Medicaid standards.
The NJ FamilyCare Aged, Blind, Disabled Programs

Some pregnant women may meet all the other requirements except for the immigration status. They may still be eligible for emergency benefits which include labor and delivery. They may qualify if they’re not eligible for any other Medicaid program.
There is another program called Medically Needy for Pregnant Women. This is designed for pregnant women who meet all the requirements except for how their financial resources exceed the income ceiling or resource limit. They may use a proviso that lets documented medical expenses taken from the income figures so that the resulting amount may then meet the income ceiling. When a pregnant woman qualifies program, they’re also entitled to receive the applicable benefits of the other FamilyCare services.
Emergency Payment Program for Aliens
